First.- Identification of the website owner

This website, hereinafter the “WEBSITE”, accessible at https://alandalustours.es, is owned by AL ANDALUS TOURS (LA BIBI ALIMENTACIÓN Y BEBIDAS, S.L.), a company incorporated under Spanish law with Tax Identification Number B19686559 and registered office at Calle Francisco Grande Covián, 20, 18100 Armilla, Granada, Spain, registered with the Granada Companies Registry in Volume 1692, Book 0, Folio 48, Sheet GR-52834, entry 1.

For notification purposes, AL ANDALUS TOURS designates Paseo de la Sabica 32, 18009 Granada, Spain, as its address.

AL ANDALUS TOURS operates as a wholesale-retail travel agency dedicated to the intermediation and marketing of tourism services and products, with registration number C.I.AN-187778-3.

Second.- Purpose of the website

AL ANDALUS TOURS makes available to members of the public, hereinafter the “user”, who access the WEBSITE information about its tourism services, as well as the possibility of directly booking and paying for such services through the channels enabled for this purpose, hereinafter the “CONTENT” and the “SERVICES”.

The WEBSITE is therefore both informational and transactional in nature.

The terms, conditions and procedure applicable to the electronic booking of tourism services are governed by the General Terms and Conditions of Contract, which form an integral part of this Legal Notice for all purposes.

AL ANDALUS TOURS may amend the content of this Legal Notice at any time. The applicable version shall be the one in force at the time of access, and the date of the latest update shall always be indicated at the top of the document.

Third.- Proper use of the services

The user undertakes to use the Services diligently, correctly and lawfully. In particular, and by way of illustration but not limitation, the following is prohibited:

1. Using the Services for purposes or effects contrary to the law, morality, generally accepted good practice or public order.
2. Reproducing, copying, distributing, publicly communicating, transforming or modifying the Services or their content, unless authorised by the holder of the corresponding rights or where legally permitted.
3. Infringing any intellectual or industrial property rights of AL ANDALUS TOURS or third parties.
4. Using information obtained through the WEBSITE to send advertising, direct sales communications or unsolicited messages addressed to multiple persons, or to market or disclose such information.

The user shall be liable for any loss or damage suffered by AL ANDALUS TOURS as a result of a breach of the above obligations or any other obligations set out in this document or in applicable law.

Minors must use the WEBSITE under the supervision and with the consent of their parent or legal guardian, who shall be responsible for purchases and use made through them. Any processing of personal data collected, where applicable, shall be governed by the Privacy Policy.

AL ANDALUS TOURS shall ensure compliance with the applicable legal framework and may, at its sole discretion and in a proportionate manner, interrupt the Service or exclude the user from the WEBSITE where there are reasonable indications of criminal conduct or conduct contrary to these terms that disrupts the operation, image or reputation of AL ANDALUS TOURS.

Fourth.- Rules of conduct for customer service

Users may contact AL ANDALUS TOURS through its customer service department, available by telephone every day of the week from 8:30 a.m. to 8:00 p.m., and by email at all times, 24 hours a day, with no guaranteed response time, provided that they comply with the following code of conduct:

1. No user may impersonate another person or organisation. Identity theft may constitute an infringement or offence under Spanish criminal and civil law.
2. Disrespectful or offensive language may not be used. Messages containing threats, serious insults or comments that may be degrading are not permitted. AL ANDALUS TOURS reserves the right to remove such content and take any corresponding legal action.
3. Customer service channels may not be used to present, mention or recommend third-party companies or websites, or to carry out marketing activities or send unsolicited communications, or “spam”. AL ANDALUS TOURS may remove such content and the accounts responsible, without prejudice to reporting the matter to the competent authorities, including, where applicable, the Spanish Data Protection Agency, where the conduct may constitute an infringement of the rules on unsolicited commercial communications.

Personal data provided through this channel shall be processed in accordance with the Privacy Policy.

Fifth.- Electronic contract with the customer

All matters relating to electronic contracting between the customer and AL ANDALUS TOURS, including the purchase procedure, prices, payment methods, the right of withdrawal and its exceptions applicable to tourism services, cancellations and other contractual terms, are governed by the General Terms and Conditions of Contract of this WEBSITE, which the user must read and accept before making a booking.

Sixth.- Applicable law and jurisdiction

These terms are governed by Spanish law.

For the resolution of any dispute arising in connection with this Legal Notice, the parties submit to the Courts and Tribunals of Granada, Spain, without prejudice to any mandatory jurisdiction that may correspond to the consumer under applicable law by reason of their place of residence, and without prejudice to any mandatory consumer protection provisions applicable in the consumer’s country of residence where it is outside Spain.

For consumers residing in the European Union, Regulation (EU) No 1215/2012 shall apply where appropriate and may confer jurisdiction on the courts of the consumer’s place of residence.
